Abstract / 要旨
本資料は、Journal of Medical Ethics Blogに2026年7月13日付で掲載された “A right that exists only as a billing rule is not yet a right” の著者による日本語訳である。
原文は、日本の2026年度診療報酬改定によって病院の面会方針の文書化、公表および定期的な見直しが求められるようになったことを評価しつつ、患者の面会が依然として明示的な権利ではなく、医療機関が診療報酬を算定するための要件として位置づけられているという制度的限界を論じている。
患者自身が制限理由を問い、再検討を求め、訴訟に至る前に救済を得られる仕組みを整備すること、および日本に患者権利法が必要であることを提言する。
