From Criteria to Consequence: Toward a Pre-Specified Escalation Rule in Post-Market Safety Governance

Abstract Post-market safety governance pre-specifies a great deal. Active surveillance monitors prespecified outcomes against statistical thresholds designed for repeated testing. European signal-management rules fix deadlines in days, do not require causality before obligation attaches, require that rationale be recorded, and publish the resulting recommendations — including recommendations that no further action is needed. The considerations bearing on those recommendations are themselves set out in advance: severity, reversibility, strength of evidence, exposed population, vulnerable groups, the consequences of discontinuation. What is not set out in advance, in the instruments examined here, is the rule connecting those considerations to an outcome. Which combination of them should issue in which response is settled in the course of assessing each signal. Reasons are given, and published, but there is no term stated beforehand against which a reader can ask whether the conclusion departed from what had been undertaken. This paper asks whether that rule should be published in advance, and proposes a specific form: not a trigger compelling a measure whenever a condition is met, but a rebuttable presumption. A published rule raises a presumption of a defined response; a regulator may depart from it, provided the departure is published, expressed against the rule, and — where the ground of departure is one the rule did not anticipate — added to the rule prospectively. What such an arrangement removes is not discretion but the freedom to settle the standard after the event it was to govern. Nuclear operating limits and drinking water notification rules show that binding a stated condition to a stated consequence is institutionally achievable in complex domains, though not that a rule of this kind could be calibrated for pharmacovigilance. Two cases show how escalation proceeds without one. The paper sets out three candidate forms such a rule might take, together with what a departure would have to contain, and leaves substantial questions open — including the decision rule under statistical uncertainty and the risk that precommitment relocates discretion into measurement. It argues that the arrangement merits evaluation, not that it should be adopted. 要旨 市販後安全ガバナンスは、実は多くを事前に規定している。能動的サーベイランスは、反復検定の ために設計された統計的閾値に対して、事前に指定されたアウトカムを監視する。欧州のシグナル 管理規則は日数単位で期限を固定し、義務の発生に因果関係の確立を要求せず、判断根拠の記録を 義務づけ、当該シグナルについて「これ以上の措置は不要」という結論を含む勧告を公表する。そ うした勧告に関わる考慮事項――重篤度、可逆性、証拠の確からしさ、曝露集団、脆弱集団、治療 中止の帰結――もまた、それ自体が事前に定められている。 本稿で検討した文書において事前に定められていないのは、これらの考慮事項をひとつの帰結へ結 びつける規則である。どの組み合わせがどの対応を導くべきかは、個々のシグナルを評価する過程 で、その都度定められる。理由は示され、公表されるが、読者には、その結論が何からの逸脱であ ったのかを問うための、あらかじめ述べられた基準が存在しない。 本稿は、その規則を事前に公表すべきかを問い、ひとつの具体的な形を提案する。条件が満たされ れば自動的に措置を強制するトリガーではなく、反証可能な推定である。公表された規則は、定め られた対応の推定を生じさせる。規制当局はそこから逸脱してよいが、その逸脱は公表され、当該 規則に照らして表現され、かつ――規則が想定していなかった逸脱事由による場合には――その事 由を規則へ将来に向けて追加しなければならない。この仕組みが奪うのは裁量ではない。奪われる のは、規律すべき出来事が起きたあとになって基準を定める自由である。 原子力の運転上の制限と水道の通知規則は、複雑な領域においても、数値による条件を定められた 帰結に事前に結びつけることが制度的に可能であることを示す。ただし、それらは本稿が提案する 種類の規則がファーマコビジランスにおいて較正しうることまでは示さない。二つの事例が、そう した規則を欠く場合にエスカレーションがどう進行するかを示す。本稿は、そのような規則がとり うる三つの候補形式と、逸脱が満たすべき要件を示し、統計的不確実性下の決定規則や、事前拘束 がかえって裁量を測定の段階へ移動させる危険を含む、多くの未解決の論点を残す。本稿が主張す るのは、この仕組みが検討に値するということであって、採用されるべきだということではない。
